Terms of service

Trip Fee:

  • A non-refundable trip fee of $39.99 will be charged for each service call to cover the cost of travel, initial diagnostics, and the availability of a qualified technician.
  • This trip fee is payable upon the technician’s arrival at the Customer’s location, regardless of whether any repairs are ultimately performed beyond the scope of a minor repair as defined below.
  • In the event the technician is unable to diagnose the plumbing issue, or if the technician did not perform the standard trip fee process properly, the trip fee will be voided and not charged to the Customer.

2. Included Minor Repairs:

  • The trip fee includes one (1) minor plumbing repair, provided the issue falls within the following scope:
    • Simple Bolt Tightening: Tightening easily accessible bolts or fasteners on existing, functional plumbing fixtures or components.
    • Simple P-Trap Resealing: Reapplying sealant to a readily accessible and structurally sound P-trap connection to resolve minor leaks. This excludes disassembly or replacement of the P-trap itself.
    • Flapper Replacement: Replacement of a standard toilet tank flapper valve with a readily available, compatible replacement. This excludes complex tank mechanisms or specialty flappers not carried by the technician.
  • The technician will assess the issue upon arrival to determine if it qualifies as a minor repair under these terms. The technician’s judgment on whether a repair is “minor” and falls within the included services is final.

3. Exclusions and Additional Charges:

  • The following are NOT included in the trip fee and will be subject to additional charges for labor and materials:
    • Repairs requiring disassembly or replacement of pipes, fixtures, or components beyond the scope of the minor repairs listed above.
    • Repairs involving significant time, specialized tools, or extensive troubleshooting.
    • Clearing of drain blockages.
    • Repairs to water heaters, sewer lines, or other complex plumbing systems.
    • The cost of any parts or materials not specifically listed as included in the minor repairs (e.g., new P-traps, specialty flappers, new bolts if existing ones are damaged).
    • Any additional plumbing issues identified beyond the initial minor repair request.
  • If the required repair extends beyond the scope of the included minor repair, the technician will provide the Customer with an estimate for the additional work before proceeding. The Customer has the right to accept or decline the additional work. If declined, only the trip fee will be charged (unless voided as per section 1).

4. Payment:

  • The trip fee is due upon the technician’s arrival (unless voided as per section 1). Payment for any additional services and materials is due upon completion of the work.
  • We accept cash, credit cards (most Major card), checks(Not Prefered). A fee may apply to certain payment methods.

5. Warranty:

  • There is no warranty, express or implied, provided on any attempts at work performed as part of the included minor repair service, or any warranty whatsoever related to this service. This service is offered as a limited courtesy to address simple, immediate issues.

6. Cancellation, Refusal to Pay, and Rescheduling:

  • The Customer must provide [Specify notice period, e.g., 24 hours] notice for cancellation or rescheduling of a service appointment to avoid a cancellation fee of $[Specify amount, if any].
  • Refusal to pay: Refusal to pay will be left to Pops Plumbing LLC for after action. Customer Must Pay for service, Trip fee, and or diagnosis if minor repair is performed and no or improper diagnoses was performed. Customer will be Blacklisted and unserviceable until Credit of trip Fee is paid to Pops Plumbing LLC.

7. Limitation of Liability:

  • To the maximum extent permitted by Texas law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in any way connected with the services provided, even if the Company has been advised of the possibility of such damages. Our liability shall be limited to the amount of the trip fee paid by the Customer.  

TERMS OF SERVICE continued

Services, parts, and repairs performed on projects considered unique, those associated with mobile homes, or any work designated as a non-permanent or temporary repair will not carry a warranty.

AUTHORIZATION TO PROCEED WITH QUOTED RECOMMENDATION the undersigned is the owner/authorized representative of the premises located at (CUSTOMER ADDRESS) where said work outlined in this invoice will be performed. I (Customer Name) hereby authorize PopsPlumbingLLC to perform such recommendations and to use such labor, materials, parts, or equipment as deemed advisable and agree that PopsPlumbingLLC retains title to equipment/materials furnished until final payment is made. If payment is not made as agreed, Pops Plumbing can remove said equipment/materials at the seller’s expense. Any damage resulting from said removal shall not be the responsibility of Pops Plumbing. understand all payment is due at time of service, unless other arrangements have been made prior to work being started. I have made, understand, and agree to all terms stated. I (CUSTOMER NAME) authorize you to proceed with the above work at the involved price of (ESTIMATE PRICE) dollars. 

I (customer name) approved and authorized the recommended work to be performed and agree the work has been performed satisfactorily. Any delay caused by events beyond the control of the contractor shall not constitute abandonment and shall not be included in calculating time frames for payment or performance. Pops Plumbing shall comply with all local requirements for building permits, inspections, and zoning. Any modification to this contract that changes the cost, materials, work to be performed, or the estimated completion date must be made in writing and signed by all parties. Otherwise, this agreement is binding and will not be cancelled by either party. By signing this invoice and authorizing the work, I agree to and accept Pops Plumbing’s full terms and conditions. I have been offered the right to review the full terms and conditions at www.popsplumbingllc.org/terms or in written form from a Pops Plumbing representative.

Pops Plumbing Parts and Repair Deposit and Refund Policy Parts and repairs approved by customers may be cancelled, and a full refund of any deposit will be provided if the part is cancelled prior to any parts being ordered or work being dispatched. If a part has been ordered prior to a request to cancel, a restocking fee of 15% of the repair will be deducted from the deposit. The remaining amount of the deposit will be refunded to the customer. If the part is not returnable, the customer’s deposit will be forfeited in its entirety, and an invoice will be sent for the part cost that exceeds the deposit. Labor hours expended by Pops Plumbing personnel to obtain a part or travel to the customer’s location will be deducted from the deposit. If the labor amount exceeds the deposit, the customer will be invoiced for the labor cost. The customer agrees to be responsible for any part or labor amount exceeding the deposit.

Indemnification: You agree at all times to defend, indemnify, and hold harmless PopsPlumbingLLC, as well as any of our affiliates, agents, contractors, officers, shareholders, employees, joint venture partners, successors, transferees, assignees, and licensees, as applicable, from and against any and all claims, causes of action, damages, liabilities, costs, and expenses, including legal fees and expenses, and physical harm, arising out of or related to our Programs, Products, Services, or Program Materials, or your breach of any obligation, warranty, representation, or covenant set forth in these Terms and Conditions or in any other agreement with us.

Limitation of Liability: PopsPlumbingLLC will not be held responsible or liable in any way for the information, products, or materials that you request or receive through or on our programs, products, services, or program materials. We do not assume liability for accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease condition or issue, or otherwise, due to any act or default of anyone or any business, whether owners, staff, agents, joint venture partners, contractors, vendors, affiliates, or otherwise, affiliated with us. We do not assume liability for any owners, staff, agents, joint venture partners, contractors, vendors, or affiliates who are otherwise engaged in rendering our programs, products, services, or program materials, or in any way or in any location. In the event that you use our programs, products, services, or program materials or any other information provided by us or affiliated with us, we assume no responsibility. In no event will we(Popsplumbingllc) be liable to any party for any type of direct, indirect, special, incidental, equitable, or consequential damages for any use of or reliance on our Program, Process, Services or Program Materials, or on those affiliated with us in any way, and you hereby release us from any and all claims, including, without limitation, those related to lost profits, personal or business interruptions, personal injuries, accidents, misapplication of information, or any other loss, physical or mental disease conditions or issues, or otherwise, even if we are expressly advised of the possibility of such damages or difficulties.

You agree that you will not use our Programs Products, Services, or Program Materials in any way that causes or is likely to cause the Programs Products, Services, or Program Materials or access to them to be interrupted, damaged, or impaired in any way. You understand that you are solely responsible for all electronic communications and content sent from your computer to this website and its content and to us.

I Customer take Responsibility for Code Compliance, Safety, and Usability: The Customer acknowledges and agrees that they are solely responsible for ensuring that the completed plumbing work meets all applicable local, state, and national plumbing codes, is safe for use, and is fit for its intended purpose. The Contractor will perform the described work in a workmanlike manner, but the ultimate responsibility for code compliance, safety, and usability rests with the Customer.

Release of Liability: The Customer hereby releases and forever discharges PopsPlumbingLLC, its owners, employees, and agents, from any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs, and expenses (including, but not limited to, attorney’s fees) of any kind or nature whatsoever, known or unknown, suspected or unsuspected, which the Customer now has or may hereafter have against the Contractor, arising out of or in any way related to the plumbing work performed under this agreement, including, but not limited to, any claims related to code compliance, safety, or usability.
